Competition Bureau to Draft New Bulletin on the Regulated Conduct Defence

 

 

OTTAWA, June 20, 2005 – In response to stakeholder feedback, the Competition Bureau will draft a new Bulletin on the Regulated Conduct Defence (RCD) for consultation in the Fall of 2005.

The Bureau received a number of submissions through a public consultation on role of the RCD in the application of competition law, particularly with respect to the Bureau's December 2002 Information Bulletin on the RCD. After reviewing the submissions, existing case law and commentaries, the Bureau has decided to immediately withdraw its current Bulletin and issue a new one.

The new Bulletin will address the RCD, along with other legal principles that may be applied by the Bureau in situations where competition law intersects with other laws enacted by various levels of government.
