Misleading Made in Canada claim

In December 2007, the Competition Bureau received a complaint regarding a product bearing a Canadian flag. The Bureau considered the representation to be an implied "Made in Canada" claim, when the product was actually made in China.

Under subsection 5(1) of the Textile Labelling Act, subsection 7(1) of the Consumer Packaging and Labelling Act, and subsections 52(1) and 74.01(1) of the Competition Act, it is an offence to make false or misleading representations.

The Bureau contacted the target company to discuss the matter, which in turn agreed to stop using the Canadian flag on the product.

The matter was resolved in April 2008.
