Natural Health Product Distributor

A company that engages in the direct–selling of a natural health product sought an advisory opinion in June 2008 on whether a proposed multi–level marketing plan would raise concerns under the Competition Act (the "Act").

The Competition Bureau initially declined to issue an opinion because the company had not received a Natural Health Product Number (NHPN) from Health Canada. There were also concerns that certain health related claims in the company's brochure were misleading. After obtaining a NHPN and altering its health related representations, the company requested another advisory opinion in October 2009.

As a result, the Bureau issued an opinion in November 2009, which revealed no issue under section 55 or 55.1 of the Act.
