Commissioner of Competition and Director of Public Prosecutions Sign Memorandum of Understanding

Ottawa, — The Commissioner of Competition, Melanie Aitken, and the Director of Public Prosecutions, Brian Saunders, are pleased to announce that they have entered into a Memorandum of Understanding (MOU) with respect to the investigation and prosecution of offences under the Competition Act, the Consumer Packaging and Labelling Act, the Textile Labelling Act, and the Precious Metals Marking Act.

The MOU was developed in response, in part, to requests from stakeholders for transparency and predictability in the working relationship between the Competition Bureau and the Public Prosecution Service of Canada (PPSC). It sets out the guiding principles of the relationship between the Bureau and the PPSC, and clearly outlines each organizations' respective roles and responsibilities at the investigative and prosecution stages of a case.

It is expected that the MOU will provide increased transparency and predictability in Bureau investigations by providing the public with a clear understanding of the interation between Bureau investigators and PPSC counsel. This is especially important within the context of the Bureau's Immunity and Leniency programs, as investigators and prosecutors have distinct responsibilities but work closely together. In addition, the MOU allows for the implementation of strategies to enhance the quality of investigations and cases presented at trial.

The MOU is not intended to change the organizations' working relationship, but to crystallize the existing relationship. The full text of the MOU is available on the Bureau's Web site.
