Ottawa, February 1, 2011 — The Competition Bureau announces that the pre-merger notification transaction-size threshold for 2011 will increase to $73 million from the 2010 threshold of $70 million.
The 2011 threshold will come into effect following publication in the Canada Gazette Part I, which we anticipate will occur on February 12, 2011.
In general, the Competition Bureau must be given advance notice of proposed transactions when the assets in Canada or revenues of the target firm generated in or from Canada exceed $73 million, and when the combined Canadian assets or revenues of the parties and their respective affiliates in, from or into Canada exceed $400 million. The threshold will be reviewed at the end of 2011 to determine the appropriate level for 2012, pursuant to the indexing mechanism set out in the Competition Act.
