Ontario Court of appeal upholds $500,000 penalty for deceptive marketing scheme

OTTAWA, February 28, 2013 — The Ontario Court of Appeal has upheld an Ontario Superior Court of Justice decision ordering an individual to pay a $500,000 administrative monetary penalty in connection with a deceptive marketing scheme.

The Court dismissed the appeal of Steve Green, who had challenged the amount of the penalty he was ordered to pay in March 2012. The Ontario Superior Court of Justice had previously found that a total of three individuals and five companies had breached the Competition Act by engaging in a deceptive marketing scheme.
