Updated instructions related to supplementary information requests in the Merger Review Process Guidelines

The Competition Bureau today released updated instructions on the production of electronic records for merging parties responding to supplementary information requests. The new instructions are included in the appendix to the Merger Review Process Guidelines.

The Bureau has updated these instructions in order to make them consistent with the recently published Guidelines for the Production of Electronically Stored Information.

Other than the appendix, all other information of the Merger Review Process Guidelines remains unchanged.

  • For transactions that are complex in nature or that potentially raise significant competition concerns, the Bureau may issue a supplementary information request to obtain additional relevant information from the merging parties.
  • The Merger Review Process Guidelines describe the Bureau's general approach in administering the two‑stage merger review process under the Competition Act, which is applicable to proposed transactions that are the subject of a pre‑merger notification filing.
