Competition Bureau releases detailed summary of reasons in Toronto real estate decision

Competition Tribunal ruled in favour of the Commissioner of Competition on April 27, 2016

The Competition Tribunal today released the reasons for its ruling against the Toronto Real Estate Board for abusing its market power by imposing restrictions on the ability of brokerages to offer innovative products and services to consumers over the internet.

A backgrounder summarizing the Tribunal’s reasons behind the April 27 ruling in favour of the Commissioner of Competition is now available on the Bureau’s website.

The reasons highlight the importance of innovation and dynamic competition in assessing whether TREB's anti‑competitive practices in the Greater Toronto Area have resulted in substantial harm to competition.

The Commissioner of Competition remains focused on achieving a timely remedy to fully address the concerns raised in his application and looks forward to the remedy hearing that will take place in Ottawa on June 2.

Quick Facts

  • The TREB case has been ongoing since 2011, when the Commissioner filed an application with the Tribunal challenging restrictions that the TREB has imposed on its members’ use and display of data in the Toronto Multiple Listing Service (MLS) system.
  • Following a hearing in 2012, the Tribunal dismissed the Commissioner’s Application. The Commissioner successfully appealed this decision, and the case returned to the Tribunal for rehearing in fall 2015.
