In December 2004, the Competition Bureau received a complaint concerning a manufacturer of a wood finishing product who promoted a Health Canada-approved product on its Web site. The claim gave the impression that the product had been approved by Health Canada, which was not the case; this gave the company an advantage in the sale of its product.
Under the civil provisions of section 74.01(1)a) of the Competition Act, the conduct of retailers who make a representation to the public that is false or misleading is subject to review.
The Bureau informed the company of the requirements of the Act. As a result, the company agreed in writing to remove from its site any claim that could give rise to concern.
This matter was resolved in March 2005.
