In September 2002, the Competition Bureau commenced a formal inquiry under subsection 52 (1) of the Competition Act with respect to a weight-loss product. The investigation focussed on unsubstantiated weight-loss claims made to the public in advertisements contained in newspapers, magazines and on the Internet.
The investigation was discontinued in November 2004 due to the inability, beyond a reasonable doubt, to link the representations in advertisements to the individuals ultimately responsible for making them.
