Materially False or Misleading Representations in Lottery and Sweepstakes Promotions

An inquiry was commenced in July 2003 into the marketing practices of a company with respect to allegedly sending deceptive notices of winning a prize and providing materially false or misleading representations in its lottery and sweepstakes promotions, thereby violating s.53 and s.52 of the Competition Act, respectively.

In December 2004 the inquiry into this matter was put in abeyance pending the outcome of a related matter which was before the courts.

While waiting for this related matter to make its way through the courts, the company stopped distributing the lottery and sweepstakes promotions in question and following the conclusion of the related matter it was determined that the Bureau will not pursue the matter further.

As a result the inquiry was discontinued in March 2007.
