In June 2006, the Bureau launched a formal inquiry under section 52(1) and 74.01 of the Competition Act concerning the marketing practices of the manufacturer and owner of a health product marketed to athletes. Sections 74.01 and 52(1) of the Competition Act prohibit the making of materially false or misleading representations to the public.
The investigation focused on unsubstantiated claims made to the public about the quantity of specific ingredients and the efficacy of the product. The company’s marketing practices and the owner in question were investigated and information was obtained regarding the examined representations.
Following changes in the fact situation, the Bureau concluded that the evidence was no longer sufficient to warrant further inquiry.
As a result, the inquiry was discontinued in March 2008.
