The Competition Bureau’s Immunity Program is one of its most effective tools for detecting and investigating criminal anti-competitive activities prohibited by the Competition Act. Under the Program, business organisations and individuals may admit their involvement in criminal activity and offer to co-operate with the Bureau’s investigation and any subsequent prosecutions. These offences include conspiracy, bid-rigging, price maintenance, false or misleading representations and deceptive marketing practices. Where Program requirements are met, the Bureau will recommend that the Director of Public Prosecutions of Canada (DPP) grant them immunity from prosecution.
Template immunity agreements have been prepared by the Director of Public Prosecutions of Canada (DPP) and are available throught the Bureau links below. Official template agreements can be obtained from the office of the DPP and will soon be available online in the Federal Prosecution Service Deskbook.
